Recent history is replete with scandalous acts and charitable acts within the business community. Unfortunately, scandalous acts seem to occur with greater frequency than charitable acts – at least as reported in the broadcast and print media. An interesting corollary to the incidence of scandalous and charitable acts is the apparent differential involvement of men and women, particularly in scandals. This article explores a possible explanation for the apparent gender differential in involvement in scandals and acts of charity. Drawing on (...) a conceptual framework of three Fundamental Moral Orientations (FMOs) – selfishness, self-fullness, and selflessness – and relevant literature on gender effects, this article explores whether men and women are perceived as differing fundamentally in how they approach moral dilemmas. This phenomenon is examined with a sample of personnel (n = 682) from the hotel industry in Turkey. Results of the study indicate that gender has some effect on the perceived adoption of FMOs, and that these gender effects are generally consistent across age, educational level, and organizational rank categories. The basis of Islamic alchemy and matter theory is found in the works of Jābir ibn Ḥayyān (d. 200/815). Jābir developed an element theory similar to Aristotle’s system. Still, he interpreted matter and substance differently by transferring the basis of the theory from elements to qualities. In Jābir’s system, qualities are more often expressed by the term “natures” (ṭabā’iʻ). In Jābir’s thought, four na- tures precede the four elements, and due to the combination of two different natures with the sub- (...) stance each time, four distinct elements with different qualities occur. In Jābir, the “primary bodies” of the natural world are no longer the four Empedoclean elements but the “four natures”; air, water, earth, and fire are made up of these natures. Thus, Jābir gave the four primary Aristotelian qualities the role of genuine elements by making them tangible, independent, and corporeal entities. According to Jābir, the operation of transforming (transmutation) of ajsād (‘bodies’) such as iron, copper, tin, and lead, which is the primary purpose of the Art of alchemy, into silver and gold is carried out within the framework of the science of mīzān. The core of this transformation is based on an idea of causality in which the four natures and their specific proportions and measures are at the center. With the idea of causality that allows chemical transformation, Jābir also succeeded in extending the possibility of transformation in alchemy from the inorganic world to the organic world to an extensive range of entities. Purpose: The purposes of this study were to assess the knowledge, attitude, and practice of radiologists and paramedics regarding accident and emergency preparedness in hospitals in the southern region of the Kingdom of Saudi Arabia and how to improve their role. Materials and methods: This was a descriptive, cross‑sectional online survey that was carried out among radiologists and paramedics in the Kingdom of Saudi Arabia. A self-structured, close-ended questionnaire that was administered that consisted of 19 questions was included. The questionnaire (...) validity and reliability were evaluated for vetting and remarks. The questions were circulated through Google Forms, and it was circulated among the study participants through online mode. The data were collected systematically, and SPSS Statistics version 26.0 was used for data analysis Results: There were 139 responses, (77 specialist's radiology and 62 paramedics) participated in the study through Google Forms. In the study group, 84 (61.4%) were know the main steps for emergency response in major emergencies (p-value 0.000). Among the 19 questions used to assess the KAP, 12 questions were significant with a p-value less than 0.05. More than 72.6% agree the Management must be adequately prepared when emergencies and accidents occur. The respondents’ attitude toward emergency preparedness was generally positiveو Only a minority, that is, 43 (30.9%) of the respondents think it is possible for cooperation between radiologists and paramedics to interpret emergency cases and develop treatment plans in the emergency department. Conclusion: The level of knowledge was satisfactory among the radiologists and paramedics with a neutral level of attitudes, practice and knowledge regarding disaster preparedness. Follow-up research is essential to maximize the preparedness of the accident and emergency department. (shrink)

This paper is devoted to Ibn Sinn's text deals with two distinct, though closely related, subjects. First he considers the classification of problems, founded on the logical criteria which are the number and degree of indetermination of the solutions and the number of hypotheses and their possible independence. This classification does not replace the Hellenistic one, which remains relevant insofar as it purports to solve geometrical problems, but complements it and has a different frame of reference, applying principally to algebra, (...) that new born science. Ibn Sinn to bestow more importance on the role played by analysis in the course of the proof, the only role left to synthesis being to check that all implications involved in the course of analysis are in fact equivalences. Zihnî temsillerin onto-epistemolojik statüsü İbn Sînâ sonrası felsefenin en tartışmalı problemleri arasında görülebilir. Problemin kökenleri bir yandan İbn Sînâ’nın farklı varlık düzlemleri arasında yüklemsel birlik elde etme teşebbüsünde, diğer yandan Fahreddin er-Râzî’nin zihnî varlık ve zihnî misallerin tümelliği eleştirisinde bulunur. El poeta andalusí Ibrāhīm ibn Sahl (609/1212-649/1251), que se convirtió del judaísmo al islam, escribió poemas pertenecientes al subgénero de la poesía amorosa conocida como al-ġazal al-ʿuḏrī sobre los amados Moisés, y con menor frecuencia Mahoma. Las investigaciones sobre Ibn Sahl se han centrado, tradicionalmente, en la cuestión acerca de si la conversión histórica al islam fue sincera o si sus poemas sobre Moisés reflejan un anhelo oculto por el judaísmo. Este artículo problematiza esta cuestión, prestando atención a lo que (...) se sabe de las circunstancias históricas en las que vivió Ibn Sahl y por medio de una discusión crítica del fenómeno de la conversión. Luego redirijo la conversación sobre la poesía de Ibn Sahl: en lugar de tratar de comprender la sinceridad de la conversión de Ibn Sahl a través de su poesía este artículo lee sus poemas como textos literarios, con atención a sus juegos de palabras, imágenes e intertextualidad. El análisis de la poesía de Ibn Sahl, que presta mucha atención a esta significativa intertextualidad, ilumina la red de referencias religiosas que hay en ella y las formas en las que funcionan dentro de la poesía. La conclusión, tras la lectura atenta de poemas seleccionados del dīwān de Ibn Sahl, es que el mérito de estos poemas y las características que los han hecho atractivos para el público proceden de las formas en que mantienen la posibilidad de diferentes interpretaciones, por lo que continuamente avivan la curiosidad del público, así como su uso, que induce a los portentos del lenguaje figurativo, la intertextualidad y los juegos de palabras. The “lost” Yaḥyā ibn ʿAdī treatises recently discovered in the Tehran codex Marwī 19 include a record of a philosophical debate instigated by the Ḥamdānid prince Sayf-al-Dawla. More precisely, Marwī 19 contains Yaḥyā’s adjudication of a dispute between an unnamed Opponent and Yaḥyā’s younger relative Ibrāhīm ibn ʿAdī (who also served as al-Fārābī’s assistant), along with Ibrāhīm's response to Yaḥyā’s adjudication, and Yaḥyā’s final word. At issue was a problem of Aristotelian exegesis: should “body” be understood as falling under the (...) category of substance or under the category of quantity? The unnamed Opponent argues that body is a species of substance; Ibrāhīm argues that technically speaking, body is a species of quantity, and hence an accident; and Yaḥyā judges that body is a species of substance, though for very different reasons than the Opponent gives. For the first time, the Arabic text of this exchange is edited and translated into English. Also provided is an Introduction that sets the debate in historical context, and discusses in particular the possible influence of John Philoponus. The debate is interesting and important not only because of the philosophical ramifications of the issues under discussion, but because it constitutes evidence of dialectical practice among Arabic-speaking philosophers from the middle of the 10th century. The primary and secondary sources of Islamic law often assume a binary distinction between ijtihād and taqlīd, ignoring a third level of engagement with the sources, which was conceptualized by some jurists as forming a distinct category. In this article I discuss the evolution of the terms ijtihād, taqlīd, and ittibāʿ, using a conceptual-historical approach. I argue that the use of taqlīd to mean “precedent-following” did not emerge as a technical term until after the time of al-Shāfiʿī. The distinction between (...) precedent-following and verifiable-following did not appear in legal discourse until the time of Aḥmad b. Ḥanbal. I also demonstrate that there were three approaches to these terms in legal discourse after the time of Ibn Ḥanbal, with three groups of jurists defining them in ways that advanced their different visions of law-making. I conclude with a discussion of the debate over the meanings of these terms in the eighteenth and nineteenth centuries. (shrink)

Reason and revelation are a topic that is debated by many parties to determine the position and superiority between reason and revelation. There are differences of opinion among thinkers regarding the position of reason and revelation. This debate has also attracted the attention of many Islamic thinkers, including Islamic philosophers. This paper explores the ontological capture of reason and revelation debate by two of the most prominent Sufi philosophers, Ibn ‘Arabī and Mullā Ṣadrā. This research employs a literature review as (...) a research methodology, with an emphasis on synthesis and integration. Through this research, it can be concluded that Ibn ‘Arabī’s and Mullā Ṣadrā’s ontological perspectives have deconstructed theological and epistemological disagreements between rationalists who place reason above revelation and their traditionalist opponents. Ibn ‘Arabī’s theory of creative imagination unveils the ontological order of reason and revelation, whereas Mullā Ṣadrā’s theories of tashkīk (gradation of being) and the union of the knower and the known during the production of knowledge (or to be more precise, the union of intellect and intelligible during intellection) consistently place reason and revelation not in opposing sides but rather in a single gradational existence. Both Ibn ‘Arabī and Mullā Ṣadrā have broken the theological and epistemological vicious cycle by introducing ontological interventions into the debate. Ibn ‘Arabī and Mullā Ṣadrā may or may not have intended to participate in the polemic; as a result, these outcomes were rarely mentioned in the historical context of the ideas. (shrink)

Cet article examine la théorie de la connaissance immédiate d' ʿAbd al-Jabbār à partir de sonMughnī, ainsi que de textes écrits par ses élèves ou par (...) des Muʿtazilites tardifs. The objective of this study is to conduct an analysis of the terminologies employed by Imam Ibn Rajab in his well-known work, "Fath al-Bari Sharh Sahih al-Bukhari," with the intention of enhancing our comprehension of his methodology in the field of Hadith studies. The study utilises a methodology that combines textual analysis and statistical techniques to examine the occurrence and usage of specific terms. The study also compares Ibn Rajab’s terminology with that of "Muqaddimah Ibn Salah" for a thorough analysis. (...) The study's main findings highlight the nuanced interpretations and variations in Ibn Rajab’s use of terminologies, specifically in synonymous terms like 'tafarrud' and 'garabah'. Furthermore, it emphasises his careful choice of the term "hasan" and the potential consequences it carries. The statistical analysis offers valuable insights into the frequency and patterns of these terminologies, which contributes to a quantitative understanding of their significance. After analysing the results, several suggestions are put forward. First, to gain a deeper understanding of Ibn Rajab's unique perspectives, it is recommended to thoroughly examine his methodologies throughout his entire body of work. Second, additional research is required to delve into the interpretations and implications of synonymous terms employed by Ibn Rajab. Third, conducting a thorough examination of his specific use of the term "hasan" would yield valuable insights into his criteria for evaluation. Fourth, it is important to conduct a thorough comparative analysis between the two texts, "Muqaddimah Ibn Salah" and the current text, to identify any similarities, differences, and potential influences. Fifth, it is recommended to broaden the statistical analysis to explore patterns, trends, and correlations within the dataset. Furthermore, gaining a broader understanding of Ibn Rajab’s contributions within the academic and scholarly landscape would greatly enhance comprehension. (shrink)

The purpose of this article is to discuss Safavid period Islamic philosopher Sadraddin Shirazi’s philosophical methodology and the sources of the school founded by him. The article relies on research conducted on Shirazi philosophy. It shows that Shirazi through synthesizing the methods of the earlier schools that existed in Islam to acquire knowledge devised a new mechanism for acquiring knowledge. Before coming to Shirazi, intellectual movements formed during Islam’s classical period, such as peripateticism, illuminationism, theology and Gnosticism, were of different (...) views regarding the best way to reach the truth. For example, for peripatetics reason, for theologians revelation, for gnostics/mystics intuition or personal experience were important, but ishraqi school was somewhere between peripatetic and Gnostic schools. Sadraddin Shirazi, though, considered all these agents necessary, for they complement each other, and said they should be utilized altogether to obtain ultimate reality. Similarly, considering his philosophical sources, we see that he is influenced almost by all philosophical schools as well as religious sources. However, Ibn Sina and Ibn Arabi’s influence on him was more profound compared to other philosophers. (shrink)

Sunnah, one of the two basic sources of the Islamic religion, has survived to the present day through transmission. The Messenger of Allah, the first interpreter of the Quran, explained the obscurities in the verses, the reason for their revelation and their context. Because, in addition to his duty to convey, he also has a duty to inform. For this reason, the Sunnah is considered a basic source, just like the Qur’an. The Qur’an was revealed fourteen centuries ago, gradually over (...) twenty-three years. It came to life with the life of the Prophet. After his passing into the afterlife, Muslims began to strive to understand the Qur’an and Sunnah correctly and to make them dominate their lives. For this reason, they made great scientific journeys and produced various works. At the beginning of these works are commentaries. Commentaries in which the verses of the Qur’an are explained with the words of the Prophet, his companions, and the followers are called narration tafsir. Maâlim at-tanzîl is an important commentary written by Baghawi (d. 516/1122) using this method. Baghawi, who lived during the founding and rise of the Great Seljuks, was born in 433/1041 in a small town called Bagshur or Bag, located between Marwarruz and Harat in the Khorasan region. In reference to this place, he was called Baghawi. He died in Marwarruz in 516/1122. He received a very good education and trained himself to produce works in the sciences of tafsir, hadith, fiqh and recitation. He narrated the Bukhari's al-Jâmi al-Sahîh from Abu Omar Abdulwahid el-Melihi (d. 463/1071), Abu Dawud’s Sunan from Abu Tahir Omar b. Abdelaziz ibn Ahmed al-Marwazi al-Fashani (d. 463/1071), Malik b. Anas’s Muwatta’ from Abu’l-Hasan Muhammed b. Muhammed ibn Saîd al-Shrazi (d.?). So much so that it can be seen that a significant part of the attributed narrations he narrated in his work called Sharhu's-sunna, as well as Maâlim at-tanzil, were the narrations he heard from the mentioned teachers. Baghawi's knowledge of isnad is also at a high level and he knows very well the narrations of the hadiths he narrated and the situations of the narrators in these narrations. In addition to criticizing the hadiths he narrated, he also evaluated their authenticity and showed that he was an authority on this subject. Maâlim at-tanzil is Baghawi's most well-known work and explains the verses with hadiths, the views of the companions, followers and later scholars. Since he was also a good haddith, he criticized the weak and fabricated narrations in the previously written commentaries. In Maâlim at-tanzil, before starting the commentary, the name of the sura, the number of verses, whether it is Meccan or Medinan, where and about what event it was revealed, are stated. First, explanations were made on the verses in terms of dictionary. Then, the interpretation of the verse with other verses and hadiths was started, the views of the companions and the followers were used, the explanation of the recitation aspects was given in detail, the different recitations were mentioned, the grammatical and syntax analyzes were made. The authority of the author in the field of hadith is clearly seen in the interpretation of the verses. The main feature of the work is that it is frequently referred to hadiths, unlike Masâbihu’s-Sunnah, most of the hadiths are narrated with their sources and almost all of them are based on the author himself. Although Israeli news were included in Maâlim at-tanzil, the author sometimes criticized them and rejected some of them. The aim of the article is to determine the author's method of using narrations in the interpretation of Surah al-Sajdah and the authenticity of these narrations. In this context, first Baghawi’s life and commentary are introduced. Later, the extraction and authenticity of the 16 narrations that the author conveyed while interpreting the surah were evaluated. The narrations have been researched in al-Kutub al-Tis'a and other reliable hadith books, especially Sharhu's-sunnah and Masâbihu's-sunnah. Based on the opinions of critics and scholars, the authenticity values of the narrations have been revealed. According to our findings, 12 of the 16 narrations were narrated with isnad and 4 without isnad. While 12 of the narrations are located only in Sharhu's-sunnah, 9 of them are only included in Masâbihu's-sunnah. The remaining 4 narrations are not included in either of his works. The distribution of the narrations in terms of the main hadith sources they are included in is as follows: 15 out of 16 narrations are located in al-Kutub al-Tis'a. 5 of these are in Bukhari, 7 in Muslim, 4 in Abu Dawud, 6 in Tirmidhi, 2 in Nasai, 2 in Ibn Majah, 1 in Darimi and 1 in Malik b. Anas’s Muwatta’ and 10 of them in Ahmed b. Hanbel. In terms of the end of the isnad, 1 is kudsî and 15 is marfû‘. In terms of authenticity, out of 16 narrations, 10 are sahih, 3 of which are muttefakun aleyh, 2 are hasan and 4 are weak. (shrink)

Nəfsin mahiyyəti məsələsi isə qədim yunan filosoflarından bəri müzakirə olunmuş və bu barədə fərqli nəzəriyyələr ortaya qoyulmuşdur. Qədim yunan filosoflarından Platon nəfsin maddi bədəndən təmamilə fərqli, qeyri-maddi bir substansiyadan təşkil olunduğunu düşünür və onun bədəndən müstəqil var ola bilən, əzəli və əbədi olduğunu iddia edirdi. Substansial dualizm olaraq tanınan bu nəzəriyyəni qəbul etməyən Aristotel isə nəfsi bədənin mükəmməlliyi kimi tərif edir və Platondan fərqli olaraq (...) onun bədəndən öncə var olması fikrini, eləcə də, ölümsüzlüyünü inkar edirdi. Şâfiî müctehidlerin muteber şahsiyetlerinden biri olan Râfiî el-Kazvînî, ilk olarak babası Muhammed b. Abdilkerîm el-Kazvînî (ö. 580/1184) ve annesinin dayısı Ebü’l-Hayr Ahmed et-Tâlkânî’nin (ö. 589/1193) rahle-i tedrisinde bulunduktan sonra alanında uzman birçok kişiden tefsir, hadis ve fıkıh sahasına ilişkin seviyeli bir eğitim almıştır. Yaşadığı asrın ileri gelen ulemasından İslâmî ilimleri okuyarak fıkıh ilminde ihtisas sahibi olan Râfiî, Kazvîn’de ders halkaları oluşturarak tedris faaliyetinde bulunmuş; dönemin halifeleri tarafından Şam ve Mısır baş kadılık görevine atanan Ahmed b. Halîl el-Mühellebî (ö. 638/1240), Zekiyyüddin (...) el-Münzirî (656/1258) ve İbn Sükkerî (ö.713/1313) gibi önemli simalar yetiştirmiştir. Zekâsı, aklı ve özellikle haiz olduğu fıkhî meseleleri ayırt etme yetisiyle Râfiî, doktrin içerisinde yer alan dağınık görüşleri toplayarak ilgili görüşlerden hangisinin daha kuvvetli olabileceğine dair tespitlerde bulunup mezhebi tahrîr/tenkîh etmiş, bir bakıma mezhebin görüşlerini ilmî elekten geçirip ayıklamıştır. Mezhep içerisindeki görüşleri inceleyerek farklı tarikleri birleştirme ve dağınık bilgileri ayıklayıp mezhep birikimini veciz ifadelerle yansıtma faaliyetinden dolayı ulemanın dikkatini üzerine çeken Râfiî, mezhepte iki otoriteden biri anlamına gelen Şeyhân’dan biri olma -diğeri ise Nevevî (ö. 676/1277)- unvanına layık görülmüştür. Bu yüzden onun hayatına ve ilmî kişiliğine Şâfiî terâcim eserlerinde oldukça yer verilmiştir. Bu çalışmada, sonraki dönemlerde mezhep görüşünü temsilde belirleyici olan Râfiî’nin ilmî kişiliği yanında mezhebi tahrîr/tenkîh etmesindeki rolüne yer verilecektir. (shrink)

The article highlights one of the most important aspects of the modernizing potential of Falsafa (hellenizing philosophy of classical Islam), associated with the significance of the soteriological concept developed within its framework for the soteriological concept that began in the 19th century reconstruction of theological discourse. On the example of the activity of Jamaladdin al-Afghani (d. 1897), Muhammad Abduh (d. 1905), Rashid Rida (d. 1935) and other reformers, it is shown how thinkers inspired by the ideals of scientific rationality and (...) socio-cultural progress overcame the eschatologism of traditional theology, applying to the intellectualistically and presentistically oriented soteriological teachings of the Muslim peripatetics, primarily Ibn Sina (Avicenna; d. 1037) and Ibn Rushd (Averroes; d. 1198). In fact, denying the normativity of hadiths (reports of proper prophetic sayings) as a source of creed-aqida, modernists exclude from the traditional list of obligatory dogmas all principles based on hadiths, including traditions on the nearness of the end of the world and the signs that precede it. The article pays special attention to the reformist rehabilitation of Falsafa’s theses, previously qualified as heterodox: the immateriality of the soul, the unresuscitatability of the earthly body, the otherness of the otherworldly corporeality, the intellectual-imaginative nature of the afterlife, the universality of final salvation (apokatastasis). Nam ibn M recently edited and translated in French by Roshdi Rashed and Christian Houzel bit ibn Qurras treatise is its large use of a form of inferences that can be said in a sense that will be explained. They occur both in proofs of theorems and in solutions of problems. In the latter case, they enter different sorts of problematic analyses that are mainly used to reduce the geometrical problems they are concerned with to al-Khw’s equations.

In the history of Islamic philosophy, one period that attracts researchers' attention, particularly in recent times, is the Safavid era. This is because the Safavid period witnessed a resurgence in philosophical thought within Islamic tradition after a period of stagnation following the classical stage that lasted several centuries. Until the middle of the last century, Western scholars, and before them orientalists, often viewed Islamic philosophy as having concluded after Ibn Rushd, due to Ghazali’s refutations. However, intellectual activities during the Safavid (...) era proved these assumptions incorrect. During the Safavid period, particularly after Shah Abbas I ascended to power and fostered a conducive environment, figures like Mir Damad and Sheikh Bahai, who enjoyed the Shah's patronage, sought to advance their intellectual perspectives. The philosophical milieu they cultivated in the Safavid capital, Isfahan, is now recognized as the Isfahan School of Philosophy. This school, characterized by its syncretic nature, endeavored to reconcile various strands of classical Islamic thought. Sadraddin Shirazi, the most renowned figure of the Isfahan School of Philosophy, succeeded in achieving this aim through his philosophical endeavors. Sadraddin Shirazi synthesized various methods of knowledge acquisition available in Islamic philosophy -whether religious, philosophical, or gnostic-and attempted to demonstrate that apparent contradictions among them were not inherent. This paper explores the scientific and philosophical environment of the Safavid period, focusing on the emergence of the Isfahan School of Philosophy and its foremost representative, Sadraddin Shirazi. This paper presents a hitherto unknown early Arabic-Latin bilingual lead seal depicting a peace pact. The similarities of the Latin signs on one of its faces with those found on a Visigothic monetary issue attributed to the city of Seville, lead us to suggest that this seal could be from the earliest phase of the Umayyad conquest of the Iberian Peninsula, and that it probably alludes to the first peace pact established by Mūsā b. Nuṣayr with that city.

: The schools of fiqh applied different methods to eliminate contradictions between narrations. In fact, this difference in methodology directly led to fiqh disagreement. Thus, a school explains within the framework of its own procedural system which of the contradictory narratives it uses as evidence, the reason for using this narrative, how they interpret other narrations about the subject or the reason for not using these reports as evidence. This article aims to chronologically examine the theory that the Ḥanafī developed (...) about antithetical narratives based on ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī, al-Pazdawī and al-Sarakhsī. Moreover, the criticisms and contributions made by the scholars of the principles of jurisprudence are determined. Frequently repeated approach in some research that the Hanafis first used the abrogation to fulfill the contradiction between the narrations is questioned within the framework of the aforementioned scholars’ viewpoints Summary: The theory of contradictory narratives, developed as part of the narration theory, has an important position in the sense of the school’s approach to the Sunnah. This is because the system that a school of jurisprudence implements to fulfill the contradiction between narrations has an important influence in scholars’ juridical opinion. In some studies carried out today, the system developed by the Ḥanafī to eliminate the contradiction between narratives is presented in two different ways as abrogation, preference, conciliation and not to use as evidence or abrogation, conciliation and applying principles. The common point of the two hierarchies of solution is placing abrogation in first rank. In order to test the accuracy of this information in this research, we studied the system that the Ḥanafi scholars who lived in the first five centuries of the Hijra followed to eliminate the contradiction between the narrations. The development of this theory in the five centuries of the Hijra was examined on the basis of the views of ‘Īsā ibn Abān, al-Karkhī, al-Jaṣṣāṣ, al-Dabūsī and al-Sarakhsī. It is an indisputable fact that the construction and development of a theory requires a process. In this context, the present study investigated when and on which principles the theory of contradictory narratives on Ḥanafīan theory of narrative/Sunnah is started to be instituted; who and for what reasons contributed to it during this evolution process and how; and how it is instituted the way of solution hierarchy in theearly period which makes a differentiation in comments between Ḥanafīan later. This theory was enriched by principles that were developed with different perspectives during a long process and its comprehensibility was boosted using new concepts and systematic expression. Ḥanafī legal theorists benefited from the opinions of masters of the jurisprudence school to enrich this theory in terms of principles. This suggests that the theory is a scientific effort aimed at discovering how masters of the jurisprudence school are following a method in the face of contradictory narratives. As far as known, Isā ibn Abān is the first theoretician to have detailed methodological explanations related to contradictory narratives between the Hanafi scholars. This shows that the theory related to contradictory narratives was established at the beginning of the third century of the hegira. 'Isā ibn Abān divides the opposite narratives into hadiths that are compatible with consensus and hadiths that are contrary to consensus on the basis of consensus. He accepts the hadith in the first group and he evaluates the hadith in the second group as the abrogated if it is authentic. It must be stated that this solution path which Isā ibn Abān put forth is of high practical value. There is no practical value in fıqh to eliminate the contradiction between the hadith which is compatible with the consensus and the hadith contrary to this consensus by the conciliation method. Moreover, giving an active role to the consensus in the determination of the abrogating and abrogated also prevents easy access to the method of abrogation. ‘Isā ibn Abān divides hadiths that are without consensus about their provisions into two: the appearance date is known and unknown. He first applied the conciliation method to fulfill the contradictions between the narrations in both groups. If the problem is not solved by the conciliation method, Isā applies the abrogation method for narrations whose the appearance date is known. The ones that the date is not known can be acceptable in accordance with the originals, and if this is not possible, he says that both narrations cannot be used as evidence. al-Jaṣṣāṣ, who is one of the people who convey mostly al-Karkhī's views on fiqh methodology, does not convey the views of al-Karkhī on contradictory narratives in integrity that we see in the transmission of 'Isā ibn Abān’s theory and its interpretation. It is understood that al-Jaṣṣāṣ benefited from the views of al-Karkhī to improve the system of Isā ibn Abān. This suggests that al-Karkhī basically accepted the system of contradictory narratives established by Isā ibn Abān. al-Jaṣṣāṣ 's most important role in the theory of contradictory narratives is based on the principles laid down by ‘Isā ibn Abān and al-Karkhī. The person who mostly contributed to this theory after al-Karkhī is al-Dabūsī. It is understood from al-Dabūsī’s accounts that he divides the contradiction into two parts, the truth and the apparent. al-Dabūsī stipulated for evaluating a contradiction as a real contradiction. These conditions are, in essence, solutions for the elimination of the contradiction. When it comes to al-Sarakhsī, he dealt with this issue more precisely with concepts such as “evidence”, “judgement”, “state”, “date is clear in the text”, “date is not clear in the text”. In the system of al-Sarakhsī, the last option is the abrogation to eliminate the contradiction. (shrink)
